Terms of Use (CheckTheFile)

1) Who we are
These Terms of Use (“Terms”) govern your use of CheckTheFile (the “Service”). The Service is operated by RUBLEV FZCO, a UAE free-zone company (“we”, “us”, “our”). Contact: support@checkthefile.io.

2) What the Service does (and does not do)
The Service lets you forward a file or paste a link in WhatsApp to receive an automated safety verdict based on checks performed via trusted third-party security providers. The Service is not an antivirus or a cybersecurity suite and does not guarantee detection of every threat. Use it as an additional precaution, at your own judgment.

2.1 Processing scope

The Service analyzes files and URLs using automated checks. Results are probabilistic safety signals, not a definitive guarantee. No security service can guarantee detection of every threat. Always use your own judgment and device-level protection. During the beta, some checks may be performed manually. Whether automated or manual, results remain probabilistic and no method can guarantee 100% detection.

3) Eligibility & account
You must (i) be legally able to enter into these Terms, and (ii) use the Service for lawful purposes only. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3.1 Content ownership & responsibility

By submitting any file, link, or content to CheckTheFile, you confirm that you own the rights to such material or have obtained all necessary permissions to share and analyze it. You agree not to upload, forward, or request analysis of any illegal, copyrighted, or third-party data without authorization. You remain solely responsible for the legality and safety of the materials you provide.

3.2 Sanctions & export control

You may not use the Service if (a) you are located in, or are a resident of, any country/region subject to comprehensive sanctions, or (b) you are a sanctioned person under applicable UAE, U.S. (OFAC), U.K. or EU sanctions. We may block or refuse service, cancel checks or refunds, and share information with processors to comply with law.

4) Acceptable use
You agree NOT to:

  • send unlawful content or files you are not authorized to share;

  • probe or overload the Service;

  • circumvent limits or quotas;

  • use the Service to build a competing database or to resell results;

  • use automation in ways that violate WhatsApp Business policies (we maintain human escalation paths via email and web support).

  • submit password-protected, encrypted or otherwise locked files or archives; we may refuse or discard content we cannot safely process;

  • submit content containing others’ personal data, payment information, government IDs or any information you are not authorized to share;

  • submit links that require login, MFA, paywalls or captchas (we cannot access gated content);

5) Plans, trials, pricing, refunds (current phase)
During this phase, we may offer limited free checks (“Trials”). Trials may be changed, limited, or discontinued at any time. If/when paid plans are introduced, all fees will be due upfront and are non-refundable except where required by applicable law. Prices are shown in USD unless stated otherwise. We may offer prorations or goodwill refunds at our sole discretion.

6) Results and third-party providers
Verdicts may use signals from third-party security providers. You acknowledge that (a) third parties may process your content and related metadata under their own terms; (b) results are probabilistic and not a guarantee of safety; and (c) you remain responsible for how you use the results.

We may share file hashes, metadata or, where legally permissible and necessary for security analysis, file samples with trusted threat-intelligence providers solely to generate a verdict. We do not sell user data and share only what is necessary to generate a verdict.

7) Intellectual property
We retain all rights in the Service, its brand, and content. You retain rights in your files and links. You grant us a limited license to process your content solely to provide the Service and operate/secure it.

8) No warranties (AS-IS)
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, or that all threats will be detected.

9) Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of data, profits, or reputation, or business interruption. 

Our aggregate liability for all claims relating to the Service shall not exceed the amounts you paid us in the 12 months before the event giving rise to liability (or USD 100 if no payments were made).

9.1 Compressed archives (ZIP, RAR, 7z, etc.)

The Service treats archives as single containers for static analysis. Internal files are not unpacked or executed. This provides general threat detection for many known threats but may not reflect the status of each embedded file.

 

9.2 Password-protected or encrypted content

Password-protected or encrypted files/archives cannot be inspected automatically and will not be processed. Any such submissions may be rejected or deleted without notice.

 

9.3 Shortened or redirected links

URL shorteners and multi-hop redirects may limit analysis. Where possible, submit the final destination URL.

 

9.4 Unsupported formats

We may refuse, ignore or delete content in formats we cannot safely process, at our sole discretion.

9.5 Indemnity

You agree to indemnify and hold us harmless from claims arising from your unlawful use of the Service or your submission of content you are not authorized to share.

10) Suspension & termination
We may suspend or terminate access (i) for violations of these Terms, policies, or law; (ii) to prevent harm; or (iii) due to operational or legal reasons. You may stop using the Service at any time.

11) Changes to the Service or Terms

We may modify the Service or these Terms with notice by posting an updated version.  

Material changes will take effect prospectively and be posted on this page.  

We may update these Terms without prior individual notice; the Effective Date will be updated accordingly.

Continued use means acceptance.

12) Governing law & dispute resolution
These Terms are governed by the laws of the UAE. Any dispute shall be finally resolved by arbitration under the DIAC Rules administered by the Dubai International Arbitration Centre (DIAC), seat DIFC, Dubai, language English. Each party bears its own legal fees, and tribunal costs as allocated in the award.
